A homeowner is not required to fix anything that you find wrong with the house!

The homeowner is only required to "disclose".

most real estate contracts to purchase are written up to say that things that do not function as intended must be repaired, but there's nothing preventing the seller from selling the house "as is".

Whether it is against the law is not really the issue. It is not against the law to have a dirty or non-existent air filter on the furnace, or to have deck sloping toward the house,but should be noted in the report. Same as with the drip leg. The appliance manufacturers are likely going to require it for proper operation, and if it's not there, all you can do as an inspector is report it as " not present, and a plumbing contractor should be consulted before closing" (maybe a little elaboration as to why a drip leg is needed).

El Paso, TX just required them December 2012.  Only required here for the water heater and furnaces..... not on gas dryer or range. Code check books are always great to have with you.
